Client Alert Update: OSHA Responds to Supreme Court – Withdraws Vaccine Mandate

On January 13, 2022, the Supreme Court of the United States issued an opinion placing the vaccine mandate on hold for all employees working for any employer with more than 100 employees. At the time, that meant no employees for these certain employers were mandated to be vaccinated.
 
Yesterday, January 25, 2022, the Occupational Safety and Health Administration (“OSHA”), announced they were formally withdrawing its emergency temporary standard requiring employers with more than 100 employees require their employees to receive the COVID-19 vaccine. OSHA’s action withdrawing the emergency temporary standard is effective today, January 26, 2022.
 
Notably, OSHA announced that while they are withdrawing the vaccination and testing emergency temporary standard, the agency intends to focus on finalizing a permanent COVID-19 Healthcare Standard. As of now, however, employers with 100 or more employees have no vaccine mandate requirement.
