NLRB Delays Effective Date of Notice Posting Requirement
In the Fall 2011 issue of the Labor & Employment Newsletter, we reported on a rule adopted by the National Labor Relations Board that will require employers to post a written notice of employee rights under the National Labor Relations Act. The rule was scheduled to take effect November 14, 2011. This Alert is to inform you that the NLRB has now postponed the implementation date of the posting requirement to January 31, 2012.
On October 5, 2011, the National Labor Relations Board announced that the implementation date for its new notice posting requirement has been extended to January 31, 2012. When the posting rule was first promulgated in the summer of 2011, the implementation date had been scheduled for November 14, 2011.
The required notice consists of a summary of the rights established by the NLRA, including the right of employees to form a union. The notice also includes a non-exhaustive list of employer conduct that is unlawful under the statute and explicitly encourages employees to contact the NLRB if they believe a violation of the law has occurred. Employers can obtain a copy of the required notice free of charge from the NLRB. The notice is also available for downloading from the Board's website, at http://www.nlrb.gov/poster.
