Ms. Lensink primarily practices commercial litigation and corporate law, with a special interest in regulated markets. Ms. Lensink has experience representing clients in a broad range of regulated industries, including telecom, energy and environmental law, and health insurance and benefit law. She also has experience in employment and labor law, representing both employees and employers in workplace discrimination and disability accommodation.

Before joining Whiteford, Ms. Lensink worked as an associate in a boutique firm’s commercial litigation practice, gaining experience litigating corporate issues before Maryland state and federal courts. She also previously served as a law clerk for the Federal Communications Commission. In law school, Ms. Lensink worked as senior staff on the Journal of Environmental and Energy Law and studied European energy markets at the Rijksuniversiteit Groningen in the Netherlands.

Employment Law Update: Supreme Court Rejects Higher Evidence Standard for FLSA Employer Determinations

On January 15, 2025, the United States Supreme Court handed down a decision with wide-reaching consequences for employers facing wage claims based on employee misclassification. In EMD Sales, Inc. v. Carrera, the Supreme Court was tasked to decide whether a higher evidentiary requirement beyond the usual “preponderance of the evidence” standard should apply to an employer’s categorization of its employees as exempt under the Fair Labor Standards Act (FLSA). Writing for a unanimous Court, Justice Kavanaugh held that there was no basis in the FLSA for holding employer classification decisions to an unusually strict standard.
