Ms. Daniel’s practice focuses on representing landlords and tenants in a full range of commercial leasing transactions to accommodate the interests of her clients in the most efficient and effective manner possible. With over three decades of experience, Ms. Daniel has represented small and large retailers (including many restaurant and other franchisees), business owners, nonprofit institutions, and medical and dental practices in negotiating the best terms for their leases throughout not only Maryland, the District of Columbia and Virginia but many other states, as well. This tenant representation includes advising when disputes with landlords arise. As a former in-house lead leasing attorney with a large shopping center developer, Ms. Daniel has deep experience in representing owners of retail projects in drafting and negotiating leases with anchor tenants, pad sites and small space retailers, and assisting in tenant default matters.  Among Ms. Daniel’s clients are office building owners and property managers for whom she drafts and negotiates leases with tenants occupying space in office buildings and advices on tenant default issues.

Ms. Daniel’s real estate practice also encompasses drafting and negotiating contracts on behalf of sellers and purchasers involving the transfer of real estate, as well as easement agreements.

  • Handled all lease negotiations for several franchisees of a prominent national retail brand in projects throughout the US
  • Handled the lease negotiations for several large businesses, including nonprofit institutions, in relocating their headquarters in Baltimore and the District of Columbia and from Maryland into northern Virginia

  • Drafted and negotiated contracts and handled closings for the purchase and sale of real property by non-profit institutions and business owners

Client Alert: The Maryland Department of the Environment Publishes New Proposed Building Energy Performance Standards That Would Impact Many Commercial Property Owners and Tenants

On September 6th, the Maryland Department of the Environment (“MDE”) officially withdrew the proposed regulations it had previously issued in December 2023, creating statewide Building Energy Performance Standards (“BEPS”) and replaced them with an entire new set of proposed BEPS regulations. The BEPS are required as part of the implementation of the Climate Solutions Now Act of 2022, which mandates that certain buildings (generally 35,000 square feet and larger, with some buildings being exempt) in Maryland achieve net zero greenhouse gas emissions by 2040, with initial reduction standards having to be attained in 2030, and building owners required to report energy data in 2025.

Strategies for Coping with Your Office Lease in the Era of COVID

The COVID-19 pandemic has upended the traditional workplace in significant ways and created countless concerns for commercial office tenants, including associations and other nonprofit organizations.  This article will detail the extent to which tenants can address these concerns within the framework of existing lease terms and conditions, as well as possible solutions and strategies for dealing with property owners. 

Pandora, a Retail Success Story Bucking the Trend

One of the brightest rays of light in today's long suffering retail market may be the launching in the United States of franchise concept stores carrying Pandora brand jewelry and accessories. The Real Deal recently met with John Jackson, Vice President of Operations for the Albert S. Smyth Co., the nearly 100 year old jewelry store business based in Timonium, Maryland, regarding Smyth's experience as a Pandora franchisee in several states. Mr. Jackson, a veteran of 22 years in the jewelry business, the last ten with Smyth and 12 before that with Sterling Jewelers, has been leading Smyth's efforts to expand from a locally operated full service jewelry store into a national mall retailer. The movement toward the greening of commercial leases took a decisive step forward with the recent announcement of the formation of an alliance of major commercial building owners endorsing a "Green Lease Action Plan" in which participant organizations commit to incorporate principles of sustainability across their building portfolios.


The Role of SCIFs in BRAC Space Construction: Issues for Building Owners

One of the major challenges facing building owners and developers in response to BRAC is addressing the defense and intelligence agencies' and contractors' need for a room, group of rooms, or an entire building for the purpose of discussing, handling, processing and/or storing Sensitive Compartmented Information or SCI. SCI is classified information which is required to be handled within formal access control systems established by the Director of Central Intelligence.

With the increasing impetus behind the movement to "go green", owners of commercial buildings should be cognizant of strategies for incorporating "green" provisions into new leases and renewals. Even if the owner is not currently in the process of obtaining LEED certification for their building, they should be mindful of when and where green lease provisions should be incorporated.

WTP Lawyers Contribute Pro Bono Services to "Wills for Heroes"

Six lawyers from Whiteford Taylor & Preston’s Baltimore, Towson and Columbia offices joined lawyers from the Legal Department of Constellation/Exelon and other law firms in the Wills for Heroes (WFH) pro bono clinic on August 1, 2012. The event was held at the Anne Arundel Fire Department Training Academy and served 35 clients without charge.
