Client Alert: Essential Policy Resolutions Every Delaware Community Association is Recommended to Adopt

In Delaware, community associations are governed principally by three statutes: (1) the Delaware Uniform Common Interest Ownership Act (“DUCIOA”), 25 Del. C. § 81-101 et seq.; (2) the Unit Property Act (“UPA”), 25 Del. C. § 2201 et seq.; and (3) the Common Interest Community Ombudsperson Act, 29 Del. C. § 2544 (the “Ombudsperson Act”). For purposes of this alert, the discussion below focuses on DUCIOA as it applies to post-2009 communities, with references to the UPA where its requirements apply to condominiums. The Ombudsperson Act, which operates independently of both DUCIOA and the UPA, establishes additional requirements—most notably the internal dispute resolution process—applicable to all common interest community associations.

Addressing Complaints of Marijuana Smoke In Community Associations Following Legalization Of Recreational Marijuana Use In Delaware and Maryland

As of April 23, 2023, and July 1, 2023, Delaware and Maryland, respectively, have legalized the personal use of marijuana. In light of the recent laws, common interest communities across these two states may soon (if not already), contemplate how to appropriately address an uptick in complaints related to marijuana smoke.

Client Alert: Delaware to Align with CDC Guidance

Governor Carney signed the Twenty-Ninth Modification of the Declaration of a State of Emergency for the State of Delaware Due to a Public Health Threat (the “29^th Modification”), eliminating Delaware’s mask mandate under most circumstances and reducing social distancing requirements effective May 21, 2020.  You can find the full 29^th Modification here.  The 29^th modification brings Delaware in line with the new guidance from the Centers for Disease Control and Prevention (“CDC”).
