  • Construction related litigation/arbitration matters on behalf of contractors and owners, including construction disputes between trades, mechanics' lien claims, defective construction claims, bid claims, contract claims, and all other such matters, in the various State and Federal courts in Maryland

  • Representation of property owners and trial of numerous County and State Eminent Domain/Condemnation cases before juries in Circuit Courts for Baltimore City, Allegany, Anne Arundel, Baltimore, Harford, Howard, Montgomery, Wicomico, and Worcester Counties

  • Numerous appeals to U.S. and State Courts of Appeals and U.S. Supreme Court over the years since 1969
  • Has obtained numerous victories in defense of lower court judgments in the Maryland Court of Special Appeals
  • Has successfully opposed Petitions for Writs of Certiorari in the Court of Appeals (Rogers v. Eastport Yachting Co. and Hollander v. Rawson)

Real Estate Litigation

  • Trial of numerous jury/court real estate cases involving adverse possession claims and prescriptive easement claims asserted by adjoining property owners
  • Successfully defended adverse possession cases in waterfront properties, in extended jury trials
 

Liquor Board Experience

  • Representation of applicants for and holders of liquor licenses in Howard County before the Liquor Board
  • Representation of liquor license holders in opposition to applications for new or modified liquor licenses by others

Basics of Condemnation

Condemnation, or eminent domain, involves the governmental taking of private property for a "public use" within the meaning of the Takings Clause of the Fifth Amendment to the U.S. Constitution. The power of eminent domain vests at all levels of government, both state and federal, but the procedures vary depending on the ultimate purpose for which the property is being taken.
