Construction Litigation
We represent owners, developers, contractors, subcontractors, sureties, and design professionals in construction contract negotiation, performance advice, and dispute management and resolution. Our size and diversity allow us to provide guidance to our clients on a full range of construction and related legal services at both the regional and national level.
Our attorneys regularly represent contractors, subcontractors, owners, sureties, and design professionals in all aspects of construction and bond disputes, including insurance and bond coverage issues, requests for equitable adjustments for labor productivity impacts or delays, breach of contract, differing site conditions, scope disputes, mechanic's liens, condemnation actions, construction defects, and other contract claims.
We handle litigation matters involving numerous types of bonds, including performance and payment bonds, and various statutory and common-law bonds. Our attorneys have successfully brought suit in numerous jurisdictions in pursuit of indemnity, exoneration, and salvage against principals, indemnitors, and other third parties in order to recoup the surety's losses.
We emphasize preventive legal services including initial assistance in drafting and negotiating contracts and real-time consultation on proper contract administration and claims procedure compliance. We always emphasize effective risk management and efficient resolution of business disputes.
We represent our clients in federal trial and bankruptcy courts, state trial courts, and appellate courts of all levels throughout the country. Our attorneys use alternative dispute resolution, participating in arbitration and mediation both as advocates for our clients and as arbitrators and mediators familiar with the construction industry.

We have both the in-depth industry knowledge and the courtroom skills to represent clients in real estate disputes. Whether it is aggressive courtroom advocacy, achieving summary disposition before trial, or economic resolution through arbitration, mediation or otherwise, we are experienced representing local, regional and national clients in a comprehensive range of real estate disputes. Representative clients include closely held and public companies, commercial and residential property owners, commercial lessors and tenants, real estate developers, home builders, contractors, condominium and community associations, and builders of large residential communities.
